Wound & Wrist Bound

Beta Terms

Last updated: [DATE]

The short version.

1. About these terms

These terms are an agreement between you and Jeff Heinzelman, who runs Wound & About and makes the Wound & Wrist Bound app ("I", "me"). They apply when you request access to or take part in the Wound & Wrist Bound beta (the "Beta"). By requesting access, you agree to these terms and to the Privacy Policy.

2. Who can join

You must be 18 or older and have a compatible iPhone, an Apple account and Apple's TestFlight app. The Beta is iPhone only for now. I aim to invite everyone who requests access, but I may limit, delay or decline invitations, for example if Apple's tester limit is reached.

3. What the Beta is

The Beta is an early, unfinished version of the app. The first version focuses on basic watch collection tracking, wear tracking, strap and bracelet tracking, and a wish list. Features may change, break or be removed, and new ones may be added. Data you enter could be reset or lost, so keep your own records of anything important. Beta builds expire on Apple's schedule and may stop working.

4. Feedback and ideas

A big part of the Beta is hearing what testers want. I will ask for feedback, feature ideas and survey responses, and you choose whether to respond.

If you send feedback, ideas or suggestions ("Feedback"), you give me a perpetual, irrevocable, worldwide, royalty free right to use, copy, modify, combine and build on that Feedback for any purpose, without payment, credit or further permission. I am not required to use any Feedback, and no suggestion is guaranteed to be implemented. Ideas similar to yours may already be planned or may come from other testers. Please do not send anything you consider confidential or that you do not have the right to share.

5. Talking about the Beta

You are welcome to talk about the Beta, post about it and share screenshots. Please keep your personal TestFlight invitation to yourself, and do not copy, resell, reverse engineer or redistribute the app.

6. Using the app

Use the Beta lawfully and do not try to disrupt it, break its security or interfere with other testers. Your use of TestFlight is also subject to Apple's terms. Apple is not responsible for the app or these terms.

7. Leaving or ending the Beta

You can leave at any time by deleting the app or leaving the Beta in TestFlight. To have your information removed, email contact@woundandabout.com. I may pause or end the Beta, or remove any tester, at any time and for any reason.

8. No warranty

The Beta is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. I do not promise that the Beta will be error free, secure or always available.

9. Limitation of liability

To the fullest extent permitted by law, I will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from the Beta. My total liability for any claim related to the Beta will not exceed US $50. Some places do not allow certain limits on liability, so some of these limits may not apply to you.

10. Changes to these terms

I may update these terms as the Beta evolves. I will update the date at the top and, for significant changes, let testers know by email. If you keep using the Beta after a change, the updated terms apply.

11. Governing law

These terms are governed by the laws of the State of Texas, United States, without regard to conflict of law rules. If you live outside the United States, you keep any rights your local consumer laws give you that cannot be waived.
